Called to Order:  7:30 PM under the M.G.L. Chapter 131, s.40 and the Hanson By-Law 1-13, s.5.  by Philip R. Lindquist, Chairman, in Meeting Room A on the second floor of the Town Hall.

Public Hearings

7:45  PM  Abbreviated Notice of Intent for construction of a 32’ x 64’ addition to replace an existing deck at 32 Country Lane, Assessor’s Map 88, Lot 8-20B with George and Karen Duclos
(DEP #175-414)

The Public Hearing Notice was read by Phil Lindquist and the green cards were checked.  George Duclos and builder Jim Mientkiewicz presented plans to remove an existing deck and replace it with a family room and an additional deck.  Ms. Cassady noted that this is an addition that was originally approved as part of the house plan.  However, there was a question as to the location of the wetland line.  Ms. Cassady will schedule a site inspection.

8:00  PM Continued Notice of Intent for partial construction of dwelling, driveway, well and site grading within the 100’ buffer zone at 90 Pratt Place, Assessor’s Map 89, Lot 1 with Christine Fiske, owner and C.W. Garvey Co., Inc., 36 West St., Whitman, MA  (DEP #175-411) – cancelled by written request of the owner

8:15 PM Notice of Intent for construction of an addition and two decks to an existing single family home at 91 Forest Trail, Assessor’s Map 101, Lot 5D-4   with owner Bruce Boyd represented by John Delano, 220 Hudson St., Halifax, MA  (DEP #175-413)

Phil Lindquist read the Hearing Notice and the green cards were checked.  John Delano, representative and Bruce Boyd, owner presented plans and a written request for a variance to the by-law.  The addition has been drawn onto the left side of the house within the 50 foot bordering vegetated wetland.  It is not possible to put the addition on the right side of the existing home as the septic is located there.  Mr. Delano has staked out the trees that need to be cut.  Also, the proposal calls for a “living shrub fence” to prevent future encroachment as there is a possible intermittent stream nearby.  The proposed driveway will be crushed stone.  Ms. Cassady will schedule a site inspection.

8:30 PM Notice of Intent for construction of a single family dwelling with on-site septic and grading at Indian Head Street, Assessor’s Map 54, Lot 1-3 with owner Paul Nawazelski, Jr. represented by John Delano.  (DEP #175-   )

Phil Lindquist read the Hearing Notice and the green cards were checked.  John Delano representing Paul Nawazelski, Jr. presented plans for a new single family dwelling.  The septic has been approved.   The wetlands have been flagged by Dr. Hewittson.  Everything is out of the 50-foot buffer zone.  Erosion control barriers have been proposed.  Some lilac bushes will be repositioned.  The hearing will be continued as the DEP number had not been received.   Ms. Cassady would like to schedule a site inspection as well.

Orders of Conditions/Determinations of Applicability/Certificates of Compliance

Amendment to an Order of Conditions to remove a chain link fence around a detention basin at Tag Way, off Whitman St., Assessor’s Map 110, Parcel 23 with Sheila Niksa, owner (DEP #175-341)  Amendment: The perimeter of the detention basin shall be planted with native shrub species, such as Serviceberry (Amelanchier arborea) or Gray Dogwood (Cornus Racemosa) at a sufficient rate to provide significant ground coverage and wildlife value.  In addition, the backside of the detention basin shall be planted with erosion control grass mix by New England Wetland Plants or an approved equal.  All required detention basin plantings shall be done upon removal
of the chain link fence surrounding said detention basin.  Plantings must be fully established before the issuance of a Full Certificate of Compliance. Also, any plantings that die prior to and up to the issuance of a Full Certificate of Compliance must be replaced immediately.  

Order of Conditions for construction of an approximately 910-foot long, 26-foot wide, paved roadway with a storm drainage system at Brook St., Edgewood Estates, Map 96, Lot 15 with R & C Realty Trust, 305 Brook St. (DEP #175-412) with special conditions:  1.Prior to the start of construction, a row of double staked haybales and silt fence shall be installed along the 50-foot buffer zone as shown on the approved plans.  2.  Prior to the start of construction, the Commission shall be notified of haybale and silt fence
installation and a site inspection shall be scheduled.  3.  There shall be no work or grading within the 50-foot no disturb zone.

Amendment to an Order of Conditions for permission to install four (4) sets of piezometers within the Bordering Vegetated Wetland at the Crystal Springs Well site off Main St., Map 45, Lot 12A with CDM, 50 Hampshire St., Cambridge, MA representing the Town of Hanson Water Department (DEP #175-372) with special conditions:   1.   No heavy equipment shall be used in wetland areas on site.  All work shall be done by hand.  2.  No dewatering shall take place in the wetland or buffer zone areas.  3.  There shall be only 4 (four) piezometer locations as shown on proposed plans.  Any additional piezometers shall require an amended Order of Conditions or at the very least, a review by the Commission.  4.  Each piezometer shall have a cover with a lock on top.  5.  The piezometer activity shall only take place in winter when there will be less disturbance.  6.  The Commission shall receive the monitoring reports from the data collected.  7.  The Commission shall receive a copy of the DEP water withdrawal permit once it has been finalized.

Discussions

In regards to making repairs at the Nathaniel Thomas Mill across the street from the Town Hall, it was Ms. Cassady’s recommendation that Don Ellis file a Request for Determination with the Conservation Committee as he is the current owner of the Mill.  Ms. Cassady will draft a letter.

A discussion ensued in relation to making a change to the By-Law at next Town Meeting to include the 50-foot no disturb zone that is currently reflected only in the Rules and Regulations.  

Craig Nicholson has been working on designing the website.  Phil Lindquist recommended that Craig contact Tom Mosher about getting information about the Town home page.

Bob Dillon and Phil Clemons, Associate Members both came to the meeting at different times (8:15 PM and 9:00 PM respectively) to discuss an Open Space Plan.  Phil Clemons had drafted some ideas and also handed out an Open Space & Recreational Properties brochure from Kingston that might be of use to Hanson as a possible template.  Phil, Bob and others are willing to start developing a “Stewardship Plan” as a first step towards the goal of achieving an Open Space Plan.  Ms. Cassady mentioned that she would be willing to assist in accessing any information needed to accomplish this goal.
